Terms of Service

The agreement that governs your use of CaribGenius.

1. Acceptance of Terms

By creating an account, downloading the CaribGenius app, or using any part of the CaribGenius service ("Service") at caribgenius.tech, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

2. The Service

CaribGenius is an exam preparation platform for Caribbean Secondary Education Certificate (CSEC) and Caribbean Advanced Proficiency Examination (CAPE) candidates. The Service includes hand-authored questions, premium lesson notes, mock examinations, AI-assisted tutoring explanations, readiness analytics, and progress tracking. Coverage and content depth evolve over time as we add subjects, units, and topics.

CaribGenius is not affiliated with, endorsed by, or operated by the Caribbean Examinations Council (CXC). All references to CSEC and CAPE are for the purpose of describing exam preparation context only.

3. Eligibility

You must be at least 13 years old to create an account independently. Users under 13 must have verifiable parental or guardian consent. By creating an account, you represent that the information you provide is accurate and that you meet the eligibility requirements of your jurisdiction.

4. Your Account

You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately if you suspect unauthorised access. You may not share, sell, or transfer your account.

We may suspend or terminate accounts that we reasonably believe are involved in abuse, fraud, automated scraping, attempts to bypass quotas or paywalls, or any other violation of these Terms.

5. Subscriptions, Billing, and Refunds

CaribGenius offers a Free tier and paid Pro and Premium tiers, each available on monthly and yearly billing. All paid subscriptions on iOS are processed by Apple via the App Store; on Android, by Google via Google Play; on the web, by Stripe.

  • Auto-renewal: Paid subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before renewal. You will be charged through your App Store, Google Play, or Stripe account.
  • Cancellation: You can cancel at any time via your App Store subscription settings, Google Play subscription settings, or by contacting Stripe customer support, depending on where you purchased. Cancellation takes effect at the end of the current billing period; you keep paid access until then.
  • Refunds: Refund requests are handled by the platform that processed your payment (Apple, Google, or Stripe), per their refund policies. We do not directly process refunds for App Store or Google Play purchases.
  • Trial periods, if offered: If a free trial is offered, you must cancel before the trial ends to avoid being charged. Trial availability and length are at our discretion and may change without notice.
  • Price changes: We may change subscription prices. Existing subscribers will be notified before any price change takes effect on their plan.

6. Exam Path and Subject Scope

Your subscription's subject scope depends on the exam path you select in your profile (CSEC, CAPE, or Both). You can change your exam path at any time in Settings. Switching paths does not change your subscription tier or billing.

7. AI Explain

The AI Explain feature uses third-party large language models (currently Anthropic) to generate tutoring-style explanations for individual questions. AI-generated content is intended as a study aid only. While we ground every AI Explain request on the question's underlying syllabus content, the resulting explanation is a synthesis and may occasionally contain inaccuracies. You should treat AI Explain output as a learning prompt, not as authoritative reference material. AI Explain is rate-limited per user and per day; see in-app messaging for current limits.

8. Acceptable Use

You agree NOT to:

  • Reverse engineer, decompile, or attempt to extract source code from the apps or APIs.
  • Scrape, copy, redistribute, or republish question content, lessons, or mock exams in any form.
  • Use automated tools to make requests against the API beyond normal in-app interaction.
  • Attempt to bypass paywalls, daily quotas, or rate limits.
  • Share account credentials with third parties or run a single account on multiple devices to circumvent quotas.
  • Use the Service for any unlawful purpose or to upload content that violates laws or third-party rights.
  • Disrupt or attempt to disrupt the operation of the Service.

9. Intellectual Property

All question banks, lessons, mock exams, branding, and platform code are the intellectual property of CaribGenius or its licensors and are protected by copyright and other intellectual-property laws. You receive a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own exam preparation. You retain ownership of any content you submit (such as feedback or attempted answers); by submitting it, you grant us a non-exclusive licence to use it for operating and improving the Service.

10. Advertising

The Service may display advertising to free-tier users via Google AdMob. Paid users do not see ads. Use of ads is governed by §5 of our Privacy Policy.

11. Disclaimers

CaribGenius is provided on an "as is" and "as available" basis. We do not guarantee any specific exam outcome, grade, or score. Readiness scores, weak-topic analyses, and AI Explain output are study aids and not predictions of actual exam performance. Content is updated regularly; while we strive for accuracy, we do not warrant that any specific question, lesson, or explanation is free of errors.

12. Limitation of Liability

To the maximum extent permitted by applicable law, CaribGenius and its operators are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, exam grades, scholarships, or admission outcomes, arising from your use of the Service. Our total liability for any direct damages is limited to the greater of (a) the amount you paid to CaribGenius in the twelve (12) months preceding the claim, or (b) US$50.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your account if we reasonably believe you have violated these Terms or applicable law. On termination, your right to use the Service ends immediately. Provisions of these Terms that by their nature should survive termination (intellectual property, disclaimers, limitation of liability) will survive.

14. Changes to These Terms

We may update these Terms as the Service evolves. The "Last updated" date at the top of this page reflects the most recent change. Material changes will be communicated in-app or via email. Continued use of the Service after updates constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the jurisdiction in which CaribGenius is operated, without regard to its conflict-of-laws principles. Mandatory consumer-protection laws of your country of residence still apply.
